Welcome to GameBack! These Terms of Service ("Terms") govern your access to and use of the services, websites, and applications (collectively, the "Service") provided by Glavien Software ("we," "us," or "our"). Please read these Terms carefully before using the Service.

1. Agreement to Terms

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. You must be at least 18 years of age to use our paid services. If you are between the ages of 13 and 18, you may use our free services only with the permission and supervision of a parent or legal guardian.

2. The Service

GameBack is a Backend-as-a-Service (BaaS) platform designed for game developers. The Service includes, but is not limited to, user authentication, data storage, leaderboards, and other backend functionalities. The Service is available in several forms: a free, self-hosted open-source version, a paid "Pro" self-hosted version, and a cloud-hosted SaaS version.

3. License and Intellectual Property

The core of our self-hosted product is licensed under the **Business Source License (BSL) 1.1**. This license allows you to use, copy, modify, and distribute the software for non-production and testing purposes freely. However, for production use in a commercial capacity that competes with our hosted Cloud offering, a commercial license ("Pro" or "Cloud") is required. All rights, title, and interest in and to the Service (excluding User Content), including all associated intellectual property rights, are and will remain the exclusive property of Glavien Software.

4. User Accounts

To access certain features of the Service, you must create an account. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately at legal@glavien.io of any unauthorized use of your account.

5. User Content

All data, information, and content that you or your end-users upload, store, or process through the Service ("User Content") remains your sole property. We do not claim any ownership rights over your User Content.

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transfer, display, perform, reproduce, and modify your User Content solely for the purpose of operating, improving, and providing the Service to you. We may also use aggregated and anonymized User Content for analytical purposes to improve our Service, but such data will never identify you or your end-users.

6. Payments, Subscriptions, and Refunds

Certain parts of the Service are available on a paid subscription basis ("Paid Services"). For our Cloud service, you will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. A valid payment method is required to process the payment for your Subscription. **This is typically handled by a third-party payment processor (like Stripe or Paddle), which securely stores your card information and manages automatic renewals.**

All fees are non-refundable. We do not provide refunds or credits for any partial subscription periods.

7. Acceptable Use Policy

You agree not to misuse the Service or help anyone else to do so. You agree not to do any of the following in connection with the Service:

  • Probe, scan, or test the vulnerability of any system or network;
  • Breach or otherwise circumvent any security or authentication measures;
  • Store or transmit any content that is unlawful, defamatory, harassing, or invasive of another's privacy;
  • Violate the law in any way, including storing or sharing content that's fraudulent or infringes on others' rights;
  • Create an unreasonable or disproportionately large load on our infrastructure.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You may terminate your account at any time by following the instructions within the Service dashboard. Upon termination, your right to use the Service will immediately cease.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND. IN NO EVENT WILL GLAVIEN SOFTWARE BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST DATA, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICE.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
